SUBJECT: First Amendment to Professional Engineering Services Contract between the City and KIT Professionals, Inc. for Westbury Area Drainage and Paving Improvements Subproject 1.
RECOMMENDATION: Approve First Amendment to the Professional Engineering Services Contract with and KIT Professionals, Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Storm Drainage Capital Improvement Plan (CIP) program and is required to improve street drainage and reduce structural flooding.
DESCRIPTION/SCOPE: This project consists of the design of storm drainage improvements, necessary concrete paving, curbs, sidewalks, driveways, and underground utilities.
LOCATION: The project area is generally bound by Willow Waterhole Bayou on the north, West Airport Blvd. on the south, Chimney Rock on the east and Landsdowne on the west.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on November 15, 2017 under Ordinance No. 2017-0891. The scope of services under the Original Contract consisted of Basic and Additional Services, as applicable, for Phase I - Preliminary Design, Phase II - Final Design, and Phase III - Construction Phase Services. The requested appropriation was for Phase I - Preliminary Design Basic and Additional Services. Under this Contract, the Consultant accomplished surveying, preliminary hydraulic/hydrology analysis, private utility research/discovery, preliminary engineering traffic analysis and preliminary tree protection plans. These tasks provided information/data for a Technical Review Committee presentation and for Preliminary Engineering Design 30% completion.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Consultant will accomplish the following: Phase II - Final Design and Phase III - Construction Phase Services. This Additional Appropriation is needed to accomplish tasks that were not included in the original contract that only appropriated Phase I - Preliminary Design. A fee of $900,841.00 is budgeted for Basic Services and $439,704.00 for Additional Services. The Additional Services are anticipated to include surveying, geotechnical investigations, Phase II environmental services, and traffic control plans, phase II drainage study utilizing Atlas 14, storm water pollution prevention plans, tree protection plans, interagency coordination meetings, and community outreach meetings.
The total requested appropriation is $1,474,600.00 to be appropriated as follows: $1,340,545.00 for contract services and $134,055.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount totals $688,185.00. The Consultant has been paid $616,787.00 (89.63%) to date. Of this amount, $85,991.95 (13.94%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $2,028,730.00. The Consultant proposes the following plan to meet the M/WBE goal.
