On June 10, 2015, Council approved a License authorizing GTE MOBILNET OF SOUTH TEXAS LIMITED PARTNERSHIP d/b/a VERIZON WIRELESS (“Licensee”) to install and operate a commercial mobile radio service antenna system at a Terminal B Garage rooftop site ("Site 1"). Licensee now desires to install antennae at two additional sites: Terminal A Roof ("Site 2") and Terminal C Garage ("Site 3"). Amendment No. 1 provides for addition of Sites 2 and 3 to the licensed equipment space, and increases license fees accordingly.
The pertinent terms of Amendment No. 1 are as follows:
Term: The Initial Term expires on March 31, 2020, and will automatically extend for one additional five (5) year period, unless earlier terminated in accordance with the License terms. Upon expiration of the Initial Term, Licensee and Licensor may each, at their own discretion, terminate the License upon a 180 days' notice.
License Fees: License Fee for is $84,000 per year ($7,000 per month) for each site. Additional Site License Fee for Sites 2 and 3 will become effective the latter of: the first day of the month after countersignature, or the first day of the month following issuance of a building permit for a particular site. Total License Fees for all three sites will be $252,000 per year.
All license fees shall increase four percent (4%) on each July 1st.
