ORDINANCE amending Ordinance No. 2005-0619, as amended, to increase the maximum contract amount for agreement for Professional Legal Services (Contract No. C56949) between the City and CLARENCE A. WEST, ATTORNEY AT LAW

Under the Agreement for Professional Services Contract C56949 (“Agreement”), Clarence A. West provides legal services to the City related to various telecommunication matters and right–of-way matters, including a complaint filed by Extenet Inc., against City of Houston at the Public Utility Commission of Texas (“PUC”).

The City continues to desire Mr. West’s assistance with the Extenet complaint at the PUC and other wireless communication matters. In addition to his telecommunications expertise, Mr. West brings specialized knowledge about past cases, hearings, and events that are not publicly available and cannot be easily found or known.

Recommendation: It is recommended that City Council approve the ordinance amending the Agreement to authorize an additional $50,000 to the contract to cover the continuing costs of the Extenet complaint at the PUC and other wireless communication matters

MWBE participation: zero-percentage goal document was approved by the Office of Business Opportunity

Pay or Play Program: The existing contract was executed prior to the effective date of the City’s ‘Paly or Play’ ordinance (“POP”); thus, it is not subject to the POP requirements.

Hire Houston First: the existing contract was executed prior to the effective date of the City’s Hire Houston First (“HHF”) Ordinance; thus, it is not subject to the HHF requirements.

Fiscal Note: Funding for this item is included in the FY2017 Adopted Budget. Therefore, no fiscal note is required as stated in the Financial Policy Ordinance No. 2014-1078.
