SUBJECT: Additional Appropriation to Professional Engineering Services Contract between the City and Scientech Engineers, Inc. for Roosevelt, Edel Plaza, and Little York Acres Drainage and Paving Improvements WBS No. M-410003-0001-3.
RECOMMENDATION: (Summary) Approve an ordinance appropriating additional funds to the Professional Engineering Services Contract with Scientech Engineers, Inc.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Capital Improvement Plan (CIP) and is required to address and reduce the risk of structural flooding. Improvements include modification of street conveyance and sheet flow, and provide detention as needed for mitigation.
DESCRIPTION/SCOPE: This project provides for the design of storm drainage improvements, necessary concrete paving, curbs, sidewalks, driveways, and underground utilities. The project will serve the Roosevelt, Edel Plaza, Little York Acres area.
LOCATION: The project is generally bounded by Airline Drive on the west, Hardy Toll Road on the east, John Albers Road on the north, and Benbrook Driveon the south. The project is located in Key Map grids 413T and 413U.
PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on May 28, 2014 under Ordinance No. 2014-0498. The scope of services under the original contract consisted of Phase I, II and III Basic and Additional Services. Under this contract, the consultant has completed the following:

SCOPE OF ADDITIONAL APPROPRIATION AND FEE: The requested additional appropriation will accomplish the following task: Completion of Phase III – Construction Phase Services.
The total requested appropriation is $89,395.00 to be appropriated as follows: $76,995.00 for contract services and $12,400.00 for CIP cost recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Consultant provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal for this project is set at 24%. The original Contract amount and subsequent First Additional Appropriation totals $601,022.00. The consultant has been paid $436,627.96 (72.65%) to date. Of this amount, $69,029.00 (15.81%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested Second Additional Appropriation, the contract amount will increase to $678,017.00. The Consultant previously satisfied the M/WBE goal established for this project :
