SUBJECT: First Amendment to the Untreated Water Supply Contract between the City of Houston and Enterprise Products Operating LLC.
RECOMMENDATION: Approval of the First Amendment to the Untreated Water Supply Contract between the City of Houston and Enterprise Products Operating LLC.
SPECIFIC EXPLANATION:
City Council approved an Untreated Water Supply Contract between the City of Houston and Enterprise Products Operating LLC (Enterprise), on November 4, 2015, by Ordinance 2015-1071.
The contract sets forth the terms and conditions for delivery of up to 6.3 million gallons per day of untreated water, to begin on or before November 10, 2016, at its facilities to be constructed at 13133 Hatcherville Road, Mont Belvieu, Texas 77521.
Because Enterprise will not complete construction of its facilities by November 10, 2016, Enterprise has requested an amendment to the contract to change the date on which it must begin receiving untreated water from November 10, 2016, to July 21, 2017.
The amendment revises the “Beginning Date” in Article I from “within one year of the effective date of the agreement” to “July 21, 2017.” All of the other terms and conditions of the original contract remain in full force and effect.
The Department of Public Works and Engineering has evaluated the request and recommends approval of the First Amendment to the Untreated Water Supply Contract between the City of Houston and Enterprise Products Operating LLC.
