SUBJECT: Interlocal Agreement for Costs Associated with U.S. Army Corps of Engineers (USACE) Review of Yale Street Bridge over White Oak Bayou. WBS No. N-140003-0001-7.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Interlocal Agreement between the City of Houston and Harris County Flood Control District and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: The Federal Off-System Bridge Program is administered by the Texas Department of Transportation (TxDOT) to replace or rehabilitate structurally deficient and functionally obsolete bridges located on public roads and streets not located on the designated state highway system. City Council approved Resolution No. 2012-0027 on August 15, 2012. The resolution was between the City of Houston and TxDOT for the construction of the Yale Street Bridge. This Resolution supported a request for a waiver of the local match requirements of the Program in return for the City agreeing to perform structural improvement work on other deficient bridges within the City’s roadway system. The project has been bid and is ready for construction. However, Harris County Flood Control District (HCFCD) will not approve the project plans until the U.S. Army Corps of Engineers (USACE) performs a Section 408 Review. White Oak Bayou is a USACE maintained channel which requires the Section 408 Review. The City is requesting an expeditious review and is willing to incur the estimated cost of $21,111.00.
DESCRIPTION: This agreement is between HCFCD and the City of Houston. HCFCD will fund the expedited review of the project by utilizing their existing agreement with USACE.
LOCATION: The project is located in Key Map Grid 492H.
SCOPE OF THE AGREEMENT: Upon review and approval of the final review by all parties, HCFCD shall notify the City of the final costs of the Review and assess the amount to be paid by the City. The City shall forward its payment to the HCFCD within 30 days of such notice.
