SUBJECT: First Amendment to Professional Engineering Services Contract between the City and Othon, Inc. for Negotiated Work Orders for Design of New and Rehabilitation of Existing Pump Stations and Flood Warning Systems. WBS Nos. M-000241-0006-3 and WBS No. M-430241-0006-3.
RECOMMENDATION: (Summary) Approve First Amendment to the Professional Engineering Services Contract with Othon, Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Storm Drainage Capital Improvement Plan (CIP) and is necessary to identify and prioritize the need for safety enhancements, improved functionality and advance flood warning to alert the traveling public.
DESCRIPTION/SCOPE: This project provides professional engineering services for assessment, design, and construction of new, and rehabilitation or improvement of existing City storm water facilities, including storm water pump stations and flood warning systems at various locations citywide.
LOCATION: Various locations citywide, specific project location and limits will be established by each work order.
PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on February 29, 2012 under Ordinance No. 2012-0173. The scope of services under the Original Contract consisted of engineering design and construction phase services, negotiated on a reimbursable basis per each work order, to repair, rehabilitate, or reconstruct existing storm water pump stations and flood warning systems. On April 3, 2013 City Council approved Ordinance No. 2013-0298 for additional appropriation to continue the design and construction phase services as defined in each Work Order.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Engineer will provide engineering design and construction phase services, negotiated based on the scope of service required and all Phases will be paid on a reimbursable basis with authorization not-to-exceed the agreed upon amount.
The total requested appropriation is $600,000.00 to be appropriated as follows: $500,000.00 for contract services and $100,000.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Consultant provides health benefits to eligible employees in compliance with City policy
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount and subsequent appropriations totals $855,000.00. The consultant has been paid $798,995.53 (93.45%) to date. The Office of Business Opportunity is in concurrence with how the consultant has identified making up the current MWBE participation deficiency with this contract amendment. Of this amount, $145,250.96 (18.18%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $1,355,000.00.
