SUBJECT: Additional Appropriation for Construction Management and Inspection Services Contract between the City of Houston and S&B Infrastructure, Ltd. associated with a Contract Award for Water and Sewer Capital Projects; WBS No. S-000020-0006-4; R-000020-0006-4.
RECOMMENDATION: (Summary) Approve an ordinance appropriating additional funds to the Construction Management and Inspection Services Contract with S&B Infrastructure, Ltd.
PROJECT NOTICE/JUSTIFICATION: These projects are associated with the City’s Water Line Replacement Program. This program is required to replace and upgrade water lines within the City to increase availability of water, improve circulation and fire protection. The Sims Bayou Widening Wastewater Utility Relocation is part of the utility conflict resolution related to Harris County Flood Control District Sims Bayou Widening and Improvement Project, and will facilitate relocation and construction of Sanitary sewer lines.
DESCRIPTION/SCOPE: This Contract provides for Construction Management and Inspection Services for Construction Branch of the Department of Public Works and Engineering in connection with water and sanitary sewer construction projects.
LOCATION: The projects are located throughout the City of Houston.

SCOPE OF THIS SUPPLEMENT AND FEE: The City Council approved the original Construction Management and Inspection Services Contract on February 15, 2012 under Ordinance Number 2012-0145 with S&B Infrastructure, Ltd. and appropriated $12,000.00 for limited pre-construction review. This Contract was referenced in Ordinance No. 2013-0272 to perform Construction Management and Inspection services for the Sims Bayou Widening Wastewater Utility Relocations. The construction contractor exceeded the time to complete the project by more than 50 percent of the original contract time. Under this Contract, the consultant required additional funds to continue performing Construction Management and Inspection services. The increased funds are due to the construction contractor, Huff & Mitchell, Inc., failure to complete the project within the contract time. The requested appropriation will complete the Construction Management and Inspection services for the proposed Sims Bayou Widening Utility Relocations. The total appropriation is $520,506.00 to be appropriated for contract services.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s “Pay or Play” ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this contract is 24%. The current total authorization for this contract is $1,670,329.34 The consultant has been paid $1,664,398.16 (99.64%) to date. Of this amount, $435,344.51 (26.16%) has been paid to M/WBE sub-consultants to date.
