Summary:

ORDINANCE appropriating $868,743.00 out of the Parks Consolidated Construction Fund; de-appropriating $281,743.00 out of Parks Consolidated Construction Fund for the Task Order and Job Order Contracting Program; awarding construction contract to GADBERRY CONSTRUCTION COMPANY INC for Meadowcreek Pavilion; setting a deadline for the bidder's execution of the contract and delivery of all bonds, insurance and other required contract documents to the City; holding the bidder in default if it fails to meet the deadlines; providing funding for the Civic Art Program and contingencies relating to construction of facilities financed by the Parks Consolidated Construction Fund - DISTRICT E - MARTIN

Background:
SPECIFIC EXPLANATION: The General Services Department (GSD) recommends that City Council award a construction contract to Gadberry Construction Company Inc on its low bid amount of $797,700.00 to provide construction services for the Meadowcreek Pavilion for the Houston Parks and Recreation Department.

On June 25, 2014, Ordinance No. 2014-0665, City Council approved an appropriation of $1,155,000.00 out of the Parks Consolidated Construction Fund to the TOC/JOC Contracting Program for FY 2014 for park improvements. Of this amount, $281,743.00 was allocated for improvements to the Meadowcreek Pavilion. After finalizing the scope of work for the project, the construction costs exceeded the TOC/JOC work order limit of $450,000.00; therefore GSD solicited bids for the project. This recommendation will de-appropriate $281,743.00 out of the TOC/JOC Contracting Program for FY 2014 and appropriate an equivalent amount to the construction contract with Gadberry Construction Company Inc for the project.

PROJECT LOCATION: 5333 Berry Creek Drive (Key Map No. 536-S)

PROJECT DESCRIPTION: The project will construct a new pavilion structure and slab to replace the old structure which was deemed unsafe and demolished. It was important to the community that the new structure have a similar architectural style with barrel roof and arched beams. The scope of work also includes lighting, basketball goals, associated drainage and landscaping improvements.

The contract duration for this project is 150 calendar days.

AWARD:   It is recommended that City Council award the construction contract to Gadberry Construction Company Inc, and appropriate funds for the project, including an additional appropriation of $17,198.25 for engineering and materials testing services under the existing contract with QC Laboratories, Inc.

 

PAY OR PLAY PROGRAM:  The proposed contract requires compliance with the City's 'Pay or Play' Ordinance regarding health benefits for employees of City contractors. In this case, the contractor has elected to play in compliance with City policy.

 

HIRE HOUSTON FIRST:  The proposed contract requires compliance with the City’s “Hire Houston First” (HHF) Ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, the proposed contractor is a designated HHF company, but they were the successful awardee without application of the HHF preference.
