Summary:

ORDINANCE approving and authorizing second amendment to Interlocal Agreement between the City of Houston and THE GREATER EAST END MANAGEMENT DISTRICT for Design and Construction of projects funded by the US DOT TIGER Grant (Approved by Ordinance No. 2013-433, as amended) - $53,372.60 - Grant Fund - DISTRICTS H - CISNEROS and I - GALLEGOS

Background:

SPECIFIC EXPLANATION:
In June 2012, US DOT awarded a $15 million Transportation Investment Generating Economic Recovery (TIGER) grant to the Houston Parks and Recreation Department (HPARD) for the project titled Houston Regional Bike/Ped Connections to Transit. A 20% ($3,991,700) local match is required. The local match for the grant will be provided by the Houston Parks Board ($3,535,542), the University of Houston ($468,275), Buffalo Bayou Partnership ($156,158) and TIRZ #3 ($300,000).

The Houston Regional Bike/Ped Connections to Transit grant project is made up of the following six sub-projects:

1. White Oak Bayou Path: Alabonson Rd/Antoine Dr Link
2. White Oak Bayou Path: 11th Street/Heights Bike Trail/Stude Park Links
3. White Oak Bayou Path: Connections to Residential Neighborhoods and Buffalo Bayou Path
4. Buffalo Bayou Path: Smith St/Travis St Link
5. East Downtown: Transit/Residential/Commercial Connections
6. Brays Bayou Path: MLK Blvd/Old Spanish Trail Link

The project that is the subject of this RCA – East Downtown: Transit/Residential/Commercial Connections (Project #5) – is estimated to cost a total of $6,173,516.00 for design and construction.

On May 8, 2013, City Council approved an Interlocal Agreement with the Greater East End Management District to commit TIGER Grant funds and any cost overruns and to outline the roles of the City and the Greater East End Management District in the implementation of Project #5. The City agreed to reimburse GEEMD for Project Management Services up to, but not to exceed $70,483.61 from TIGER grant funds.

On February 12, 2014 City Council approved the first Amendment to the Interlocal Agreement authorizing the Department to also reimburse GEEMD for Construction Management Services up to, but not to exceed $311,627.40.

Project duration has exceeded the original schedule, so additional hours of Construction Management Services (CMS) need to be added to the budget. The Department and GEEMD desire to amend the agreement again to increase the authorized amount which can be reimbursed to GEEMD for CMS up to, but not to exceed $365,000 making the total allocation to GEEMD for Project Management Services and Construction Management Services $435,483.61. The funds for this additional allocation will come from unused construction contingency.

Council approval is recommended.
