ORDINANCE approving and authorizing second amendment and appropriating $750,000.00 out of Street & Traffic Control And Storm Drainage DDSRF as an additional appropriation for Professional Engineering Services Contract between the City of Houston and CIVILTECH ENGINEERING, INC for Pre-Engineering of Storm Water Drainage Improvements (Approved by Ordinance No. 2012-0225, as amended)

Background:

SUBJECT: Second Amendment and Additional Appropriation to Professional Engineering Services Contract between the City and CivilTech Engineering, Inc. for Pre-Engineering of Storm Water Drainage Improvements.   WBS. No. M-000100-0012-3.

 

RECOMMENDATION:  (Summary)  Approve a Second Amendment and an Ordinance appropriating additional funds to the Professional Engineering Services Contract with CivilTech Engineering, Inc. 

 

PROJECT NOTICE/JUSTIFICATION:  This contract is to perform pre-engineering of storm water drainage improvements. Developing specific detailed projects to address the identified highest needs will provide candidate projects with both costs and benefits defined for citywide comparison and ranking for implementation.

 

DESCRIPTION/SCOPE:  This project is part of the Storm Drainage Capital Improvement Plan (CIP) and is required to provide professional engineering services to investigate, verify, and define storm water drainage problems, structural flooding, and storm sewer system capacity issues. The project will identify feasible, warranted, and cost effective solutions.

 

LOCATION:  The project location and limits will be established by the work order.

 

PREVIOUS HISTORY AND SCOPE:  The original Contract was approved by Council on March 21, 2012, under Ordinance No. 2012-0225. An amendment and subsequent appropriation was approved on December 18, 2013, under Ordinance No. 2013-1179. The scope of services consisted of the execution of pre-engineering services and preparation of an engineering report.  The pre-engineering services is to develop specific detailed solutions to address highest need areas and to define the candidate projects with detailed scopes, cost estimates and benefits.  Under this contract, the consultant has been performing pre-engineering services on 12 highest need areas in FY13 to FY16 following the three step process (Define Problem, Develop and Prioritize Alternative Solutions, and Develop Candidate Projects).

 

SCOPE OF THIS AMENDMENT AND ADDITIONAL APPROPRIATION AND FEE:  The scope of services for the requested appropriation is unchanged from the original contract. The requested amendment is to change the Contract Term from three (3) years with an option for one (1) renewal term of two (2) additional years to five (5) years with an option one (1) renewal term of two (2) additional years.  The requested additional appropriation will allow the consultant to perform pre-engineering services for upcoming highest need areas to develop FY17 Candidate Projects.  Pre-Engineering Design Services and Additional Services fees will be negotiated on a reimbursable basis with a not-to-exceed agreed upon amount based on the scope of the work order.  The total Professional Engineering Services and Additional Services Fee for Pre-Engineering of Storm Water Drainage Improvements under the additional appropriation is $750,000.00.

 

PAY OR PLAY PROGRAM:  The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors.  In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.

 

MWBE INFORMATION:  The MWBE goal for the project is set at 24%. The original contract amount and subsequent appropriations totals are $1,500,000.00. The consultant has been paid $1,307,473.60 (87.16%) to date.  Of this amount $253,826.00 (19.4%) has been paid to M/WBE sub-consultants to date.  The consultant has proposed the following firms to achieve this goal.  Assuming approval of the requested additional appropriation the contract amount will increase to $2,250,000.00.
