SUBJECT: Contract Award for Concrete Panel Replacement Program – Work Order Contract WBS No. N-321038-0014-4.
RECOMMENDATION: (Summary) Reject low bid, return bid bond, award construction contract to the second low bidder and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City Wide Panel Replacement Program and is required to improve and maintain a safe road surface and accessibility.
DESCRIPTION/SCOPE: This project consists of the resurfacing of arterial and major thoroughfare streets with concrete panel replacement along with the repair and improvements to curbs and accessible ramps. The project involves the design and construction of concrete panels, base repair and pavement markings as needed. The contract duration for this project is 365 calendar days.
LOCATION: Major thoroughfares and arterials throughout the City of Houston.
BIDS: This project was advertised for bidding on April 3, 2015. Bids were received on April 23, 2015. The eight (8) bids are as follows:

AWARD: The apparent low bidder, Meritt Group Construction, Inc., was considered non-responsive per the City of Houston Code of Ordinances, Sec. 15.85 by failing to submit acceptable documents as per Document 00200. Therefore, it is recommended that this construction contract be awarded to the second low bidder Main Lane Industries, Ltd. with a bid of $2,917,110.00.
PROJECT COST: The total cost of this project is $3,396,335.00 to be appropriated as follows:
· Bid Amount $2,917,110.00
· Contingencies $145,856.00
· Engineering and Testing Services $100,000.00
· CIP Cost Recovery $233,369.00
Engineering and Testing Services will be provided by Geotest Engineering, Inc. under a previously approved contract.
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ ordinance that promotes economic opportunity for Houston business and supports job creation. In this case Main Lane Industries, Ltd. is a designated HHF company, but they were the successful awardee without the application of the HHF preference.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The contractor has submitted the following proposed program to satisfy the 12% MBE goal, and 7% WBE goal for this project.
