Summary:

ORDINANCE approving and authorizing amended and restated Managed Care Dental Agreement (DHMO PLAN) between the City and ALPHA DENTAL PROGRAMS, INC, and the amended and restated Group Dental Indemnity Agreement (DPO PLAN) between the City and DELTA DENTAL INSURANCE COMPANY, for City employees, retirees, deferred retirees, survivors and certain dependents, effective May 1, 2016

Background:

Ordinance approving and authorizing amended and restated Managed Care Dental Agreement (DHMO Plan) between the City and Alpha Dental Programs, Inc. and Group Dental Indemnity Agreement (DPO Plan) between the City and Delta Dental Insurance Company for City employees, retirees, deferred retirees, survivors and certain dependents, effective May 1, 2016.

Prior Council Action:

On January 13, 2016, by Ordinance No. 2016-0028, City Council approved the Managed Care Dental Agreement (DHMO Plan) between the City and Alpha Dental Programs, Inc. (administered by Delta Dental Insurance Company), and the Group Dental Indemnity Agreement (DPO Plan) between the City and Delta Dental Insurance Company, to be effective May 1, 2016.

On or about April 14, 2016, the Texas Department of Insurance (TDI) sent to Delta Dental Insurance Company and Alpha Dental Programs, Inc. (administered by Delta Dental Insurance Company) Notices of Proposed Disapproval under 28 TAC §1.704 regarding the forms of the above two agreements, and requested that corrections be made to conform to certain sections of the Texas Insurance Code (TIC) and the Texas Administrative Code (TAC).  The corrections requested by TDI of Delta Dental Insurance Company and Alpha Dental Programs, Inc. did not affect the dental benefits in the plans.

Delta Dental Insurance Company and Alpha Dental Programs, Inc. immediately complied and submitted all requested corrections to TDI, and both agreements, as amended, were approved by TDI on April 29, 2016. 

The amended agreements will supersede and replace the agreements adopted by City Council by Ordinance 2016-0028.

The Human Resources Department requests that City Council adopt the amended and restated Managed Care Dental Agreement and the Group Dental Indemnity Agreement, as approved by TDIOn
