SUBJECT: An Ordinance to approve a Treated Water Supply Contract between the City of Houston and Harris County Water Control and Improvement District - Fondren Road.
RECOMMENDATION: Approve an ordinance authorizing a Treated Water Supply Contract between the City of Houston and Harris County Water Control and Improvement District - Fondren Road.
The City of Houston (“Houston”), City Council, approved a Water Supply Contract (“Original Contract”) on September 3, 1997, Ordinance 97-1065 with Harris County Water Control and Improvement District – Fondren Road (“District”) so that Houston could sell treated water to the District. Similarly, Southwest Harris County Municipal Utility District No. 1 (“MUD No. 1”) has been receiving water from Houston pursuant to a Water Supply Contract, approved by Houston City Council by Ordinance No. 95-1306. For engineering reasons, MUD No. 1 has requested permission from Houston and the District to receive water from Houston through the District’s system, rather than from Houston’s system directly, and to terminate its existing contract with Houston. As allowed by the Chapter 47 of the City of Houston Code of Ordinances, Harris County Water Control and Improvement District – Fondren Road (“District”) has requested to enter into a Treated Water Supply Contract with the City of Houston to provide service to both MUD No. 1 and the District.
The District will operate and maintain its internal water distribution system. The initial minimum monthly contract amount is 7,470,000 gallons of water per month and the maximum amount is 24,000,000 per month during the term of the contract. This contract will charge rates for treated water as specified in the City of Houston Code of Ordinances, Section 47-61(f). The District will also be required to pay impact fees in accordance with the contract and applicable ordinances.
The contract has been designed to address water shortages, encourage water supply management, and provide flexibility to better respond to development demands and drought conditions. The District will be required to meet all regulatory requirements.
The City of Houston Infrastructure Planning Branch has evaluated the request and found that the water supply and delivery system is adequate to provide the requested quantities.
