RECOMMENDATION: (Summary) Reject low bid, return bid bond and award construction contract the next low bidder and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City’s Capital Improvement Program to increase the safety, chemical capacity, reliability and the efficiency of operations at the East Water Purification Plant.
DESCRIPTION/SCOPE: The project consists of construction of improvements to storage and feed systems for: ammonia, sodium hydroxide, lime, powdered activated carbon, hydrofluosilicic acid, flocculant aid polymer, ferric and aluminum sulfate, filter aid polymer feed system; modifications to Plant 1-2 instrumentation and control system, including system programming, and all necessary electrical and instrumentation improvements for the control and application of the improved chemical systems.

LOCATION: This project is located at 2300 Federal Road in key map grids 496 U and Y.
BIDS: This project was advertised for bidding on November 20, 2015. Bids were received on January 7, 2016. The four (4) bids are as follows:

AWARD: The low bid of $8,353,335.00 was submitted by A Status Construction, LLC. A Status Construction, LLC, was considered non-responsible as per City of Houston Document 00200, Section 14.0B (not presenting satisfactory evidence that the bidder has regularly engaged in performing construction work as proposed, and has the capital, labor, equipment, and material to perform the work). It is recommended that this construction contract be awarded to the second low bidder, Industrial TX Corporation, with a bid of $9,568,995.00 and that Addenda No. 1 and 2 be made a part of the contract.
PROJECT COST: The total cost of this project is $10,915,000.00 to be appropriated as follows:

· Contingencies $478,449.75
· Engineering and Testing Services $75,000.00
· CIP Cost Recovery $287,655.25
· Construction Management $504,900.00
Engineering and Testing Services will be provided by Geoscience Engineering and Testing, Inc. under a previously approved contract.
Construction Management Services will be provided by CB&I Environmental & Infrastructure, Inc. under a previously approved contract.
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, the proposed contractor meets the requirements of Hire Houston First.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides benefits for some employees but will pay into the Contractor Responsibility Fund for others, in compliance with City policy.
