SUBJECT: An Ordinance to approve a Road Maintenance Agreement between the City of Houston and Harris County Fresh Water Supply District No. 48.
RECOMMENDATION: (Summary) Approve an ordinance authorizing the Mayor to execute a Road Maintenance Agreement between the City of Houston and Harris County Fresh Water Supply District No. 48.
SPECIFIC EXPLANATION:
The City of Houston (“Houston”), City Council, approved the creation Harris County Fresh Water Supply District No. 48 (“the District”) on September 24, 2008, Ordinance 2008-831. Under the Ordinance, HCFWSD 48 is authorized to construct, maintain, and operate roads within the established district boundaries.
Harris County Fresh Water Supply District No. 48 desires operate and maintain a paved road and all associated improvements and infrastructure (“Road”) within the public road right-of-way depicted in Exhibit “A” (“Service Area”). The Road and associated public road right-of-way are adjacent to the District boundary and will provide public access to the District. The City agrees to allow the District to have access to the Service Area in accordance with the terms and conditions of this Maintenance Agreement (“Agreement”).
This Agreement establishes the respective duties and obligations of the District and the City of Houston concerning ownership, operation, maintenance, repair, and replacement of these improvements.
