ORDINANCE approving and authorizing Utility Functions and Services Allocation Agreement between the City of Houston and HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 529 DISTRICT G - PENNINGTON

Background:

SUBJECT:  An Ordinance authorizing the execution of a Utility Functions and Services Allocation Agreement between the City of Houston and Harris County Municipal District No. 529.

 

 

RECOMMENDATION:  (Summary)  Approve an ordinance authorizing the Mayor to execute a Utility Functions and Services Allocation Agreement between the City of Houston and Harris County Municipal Utility District No. 529.

 

SPECIFIC EXPLANATION:

 

Request that City Council approve a Utility Function and Services Allocation Agreement between the City of Houston and Harris County Municipal Utility District No. 529.  The District consists of 86.092 acres of land located in the vicinity of Westheimer Road, Briar Forest and Eldridge Parkway, and is entirely within the corporate limits of the City.  Development of the tract will require storm drainage and water and wastewater service, including collection, distribution, treatment and water supply facilities.

 

The District will construct improvements in accordance with City standards and will convey all facilities to the City as they are constructed.  The agreement establishes the terms and conditions which govern services provided.  The City will acquire the infrastructure of the District, and will collect taxes and wastewater and water revenues from residents of the District on the same basis as all other City customers.  When applicable, the City will make annual payments to the District for that portion of the taxes collected within the boundaries of the District which represent duplicate taxes for storm water facilities charged by both the District and the City.  Projected build out of the District will result in an estimated $281,000,000 in assessed value.
