RECOMMENDATION: (Summary) It is recommended City Council approve an ordinance authorizing a Declaration of Street Right-of-Way and the dedication to the public of 1) an 82,601-square-foot street right-of-way out of a 17.2363 acre tract of fee-owned land, and 2) a 93,363-square-foot street right-of-way out of an 8.018 acre tract of fee-owned land, out of the Victor Blanco Five League Grant Survey Abstract 2. Parcels AY16-003A and AY16-003B.
SPECIFIC EXPLANATION: Locke Braly, on behalf of Hyperion Properties (Hyperion), in partnership with the Harris Country Fresh Water Supply District No. 48 (FWSD 48), requested the dedication to the public of a 70-foot-wide road right-of-way out of a portion of the private access road to the Northeast Water Treatment Plant. In exchange for the dedication of the road right-of-way, FWSD 48 will accept maintenance of the road since the road will serve as an entry to property located within FWSD 48. The dedication to the public of the road requires a Maintenance Agreement to be executed between the City and FWSD 48. Request for approval of the Maintenance Agreement will be via a separate RCA submitted to City Council.
The City originally acquired the Northeast Water Treatment Plant property in 1983 by deed under Harris County Clerk’s File number H870227. The subject property is under the jurisdiction of the Department of Public Works and Engineering – Public Utilities Division (PWE-PUD). PWE-PUD reviewed and approved this request. The Department of Public Works and Engineering– Planning and Development Services Division (PDSD) - Office of the City Engineer (OCE) reviewed and approved the plans detailing the road. Because the public road will be created from city-owned land, monetary consideration is not part of this transaction.
Therefore, it is recommended City Council approve an ordinance authorizing a Declaration of Street Right-of-Way and the dedication to the public of 1) an 82,601-square-foot street right-of-way out of a 17.2363 acre tract of fee-owned land, and 2) a 93,363-square-foot street right-of-way out of an 8.018 acre tract of fee-owned land, out of the Victor Blanco Five League Grant Survey Abstract 2. This declaration instrument will be recorded in the real property records after FWSD 48 has executed the above referenced Maintenance Agreement.
