ORDINANCE approving and authorizing Utility Functions and Services Allocation Agreement between the City of Houston and HARRIS COUNTY IMPROVEMENT DISTRICT NO. 12 - DISTRICT K - GREEN

Background:

SUBJECT:  Utility Functions and Services Allocation Agreement between the City of Houston and Harris County Improvement District No. 12..

 

RECOMMENDATION:  (Summary)  Approve an ordinance authorizing the Mayor to execute a Utility Functions and Services Allocation Agreement between the City of Houston and Harris County Improvement District No. 12.

 

SPECIFIC EXPLANATION:

 

Request the City Council authorize the execution of a Utility Functions and Services Allocation Agreement (the “Agreement”) between the City of Houston and Harris County Improvement District No. 12 (the “District”).  The District consists of 239.067 acres of land located in the vicinity of Holmes Road, West Bellfort Boulevard, Old South Main, and Buffalo Speedway and is entirely within the corporate limits of the City of Houston.  Development of the District will require storm drainage and water and wastewater service, including collection, distribution, treatment and water supply facilities.

 

The Agreement establishes the terms and conditions which govern services provided and payments to be made by the parties.  The District will construct improvements in accordance with City standards and specifications and the District will convey all facilities to the City as they are constructed.

 

In addition to acquiring the infrastructure of the District, the City will collect taxes and water and wastewater revenues from residents of the District on the same basis as all other City customers.  Projected build out of the District will result in an estimated 5,000 connections to the Combined Utility System to serve the property within the District at full development, which the City will endeavor to provide.
