ORDINANCE  approving  and  authorizing  Telecommunication  License Agreement between NEW CINGULAR WIRELESS PCS, LLC,  as Tenant,  and the  City  of  Houston,  Texas,  as Landlord, for space in  the Houston  Police Department Headquarters Building Parking Garage at 1200 Travis  Street,  Houston, Texas - 5 Years with two five-year renewals - DISTRICT I - GALLEGOS

SPECIFIC EXPLANATION:  The General Services Department recommends approval of a Telecommunications License Agreement with New Cingular Wireless PCS, LLC for roof top and seventh floor lease space in the HPD Headquarters Building Parking Garage at 1200 Travis Street.  New Cingular has used this site since 1996, for the purpose of installing, operating, and maintaining a commercial wireless telecommunications service facility.   The Telecommunications License Agreement provides for the following major provisions:  

Term – Five-year initial term, with two automatic five- year renewal terms.  

License Fee – $5,174.68 per month ($62,096.16 per year) during the initial year of the Initial Term, with an annual 3% escalator after the first year and each successive year during the Initial Term and any Renewal Term.  

Utilities – Licensee is responsible for maintenance and utilities.  

Termination – Licensor or Licensee may at any time, for any reason, terminate this License by delivering 180 days prior written notice to the other party.
