Background:

As part of a holistic approach towards addressing street homelessness, the Director of Public Safety and Homeland Security requests Council approval of an amendment to the Civility Ordinance adding a new designated area within and surrounding the East End between Chartres, Buffalo Bayou, 75th Street and Capitol (“East End Area”). The proposed ordinance would prohibit sitting, lying, or storing belongs on a sidewalk in the designated East End Area at all times, including overnight.

Pursuant to Section 40-353(i) of the City Code, City Council may create a designated area subject to the Civility Ordinance on its own authority, provided that City Council receives evidence, substantiated by the police department, that a particular area within the City exhibits a significant incidence of the kinds of conduct addressed by the Civility Ordinance and makes the findings required under Section 40-353(h)(2) and (h)(3) of the City Code.
