Specific Explanation:
The Director of the Parks and Recreation Department and the Chief Procurement Officer recommend that City Council approve spending authority in an amount not to exceed $924,804.00 for a term through May 31, 2026 with four, one-year options to extend for the purchase of grass seed through the Texas Local Government Purchasing Cooperative (BuyBoard) supplier Heritage PPG for the Parks and Recreation Department.
The Cooperative Agreement expires May 31, 2026 (“Expiration Date”). If BuyBoard and Heritage PPF agree to extend the Cooperative Agreement before the expiration date, this award authorizes the City to purchase grass seed under the extended Cooperative Agreement and automatically extends the term of this award to match the term of the extended Cooperative Agreement. If BuyBoard and Heritage PPG do not agree to extend the Cooperative Agreement before the expiration date, but BuyBoard and Heritage PPG execute a new Cooperative Agreement with substantially similar terms and conditions, as determined by the CPO, as the existing Cooperative Agreement before the end of the term of this award, this award authorizes the City to purchase grass seed under the new Cooperative Agreement and automatically extends the term of this award to match the term of the new Cooperative Agreement. Notwithstanding the foregoing, the term of this award, including any renewals or extensions, shall not exceed five years.
This is for the purchase of grass seed primarily for the Memorial Park Golf Course, which includes Champion Fine Seed Blend, Maximum POA Triva Blend, 46-0-0 Fairway and 21-0-0 Fairway grass seed.
This recommendation is made pursuant to subsection 271.102(c) of the Texas Local Government Code, which provides that “a local government that purchases goods or services from a cooperative purchasing program or organization satisfies any state law requiring the local government to seek competitive bids for the purchase of the goods or services.

Hire Houston First:
This procurement is exempt from the City's Hire Houston First Ordinance. Bids/proposals were not solicited because the department is utilizing a Cooperative Purchasing Agreement for this purchase.
Fiscal Note:
Funding for this item is included in the FY26 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
