SUBJECT: Petition for the City’s consent to the addition of 4.635 acres to Fort Bend County Municipal Utility District No. 23.
RECOMMENDATION: Petition for the City’s consent to the 4.635 acres to Fort Bend County Municipal Utility District No. 23 be approved.
SPECIFIC EXPLANATION: Fort Bend County Municipal Utility District No. 23 (the “District”) was created through the TCEQ in 1978 and currently consists of 1,308.445 acres within Fort Bend County. The District is within the extraterritorial jurisdiction of the City of Houston (the “City”) and has petitioned the City for consent to add 4.635 acres of vacant land proposed to be developed as institutional property, to the District. The proposed annexation tract is in the vicinity of State Highway 6, Trammel Fresno Road, Teal Bend Boulevard and Kansas Street. The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.
The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.
The District has a wastewater collection system and treatment facility. The annexation tract will be provided with wastewater treatment by the Fort Bend County Municipal Utility District No. 23 Wastewater Treatment Facility. The plant also provides wastewater treatment to Fort Bend County Municipal Utility District No. 24. Potable water is provided by the District.
The nearest major drainage facility for Fort Bend County Municipal Utility District No. 23 is Middle Oyster Creek and Long Point, which flows into Flat Bank Creek, then into the Brazos River, and finally into the Gulf of Mexico. Middle Oyster Creek and Long Point is within
the Middle Oyster Creek watershed. The proposed annexation tract is not within the 100- or 500-year floodplain.
By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City prior to their construction.
The Utility District Review Committee recommends that the subject petition be approved.
