SUBJECT: Ordinance authorizing the sale of: 1) a ±89,145 square-foot easement for right-of-way purposes, 2) a ±1,525 square-foot easement for right-of-way purposes, and 3) a ±5,370 square-foot easement for right-of-way purposes, all located out of a 589.27 acre tract and a 56.50 acre tract, all out of the William Wilson Survey, A-838, and/or the Humphrey Jackson Survey, A-37.Parcels SY18-019A through SY18-019C
RECOMMENDATION: It is recommended City Council approve an ordinance authorizing the sale of: 1) a ±89,145 square-foot easement for right-of-way purposes, 2) a ±1,525 square-foot easement for right-of-way purposes, and 3) a ±5,370 square-foot easement for right-of-way purposes, all located out of a 589.27 acre tract and a 56.50 acre tract, all out of the William Wilson Survey, A-838, and/or the Humphrey Jackson Survey, A-37, and the License Agreement between the City of Houston and the San Jacinto River Authority for the joint use of a road maintained by the San Jacinto River Authority as part of the sale of the easements. SPECIFIC EXPLANATION: Daniel Hidebrandt of San Jacinto River Authority (the Authority) requested the sale of: 1) a ±89,145 square-foot easement for right-of-way purposes, 2) a ±1,525 square-foot easement for right-of-way purposes, and 3) a ±5,370 square-foot easement for right-of-way purposes, all located out of a 589.27 acre tract and a 56.50 acre tract, all out of the William Wilson Survey, A-838, and/or the Humphrey Jackson Survey, A-37. The Authority requires the right-of-way easements to re-grade the side slopes of its main raw water canal downstream of the Lake Houston Pump Station. Houston Public Works - Houston Water reviewed and approved the sale of the subject easements out of the City's fee-owned tracts of land subject to the Authority's permitting the City's joint use of a road maintained by the Authority. Under the License Agreement, the City of Houston would be granted access to the Authority's road for the purpose of obtaining access to the Lake Houston dam and spillway. Under the terms of the License Agreement, the City is responsible for and will pay annually to the Authority an amount not to exceed $50,000.00 for the annual maintenance expense incurred by the Authority. The value of the easements will be credited toward the amount owed by the City for a portion of the annual costs associated with the maintenance, repair, and rehabilitation of the road.

FISCAL NOTE: Revenue for this item is included in the FY2026 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
