Summary:

ORDINANCE finding and determining that public convenience and necessity no longer require a 20 foot-wide Prescriptive Storm Sewer Easement in the location of Tacso Street west of the right-of-way line of Fondren Road, being adjacent to Lot 2 in the town of Jeanetta Addition, out of the H.T.R.R. Company Survey, Abstract 395, Harris County, Texas; abandoning the easement to FONDREN 5650, LLC, the Underlying Fee Owner, in exchange for a cash payment of $25,813.00 - DISTRICT J - POLLARD

Background:

SUBJECT: Ordinance authorizing the abandonment and sale of a 20 foot-wide prescriptive storm sewer easement in the location of Tasco Street west of the right-of-way line of Fondren Road, being adjacent to Lot 2 in the Town of Jeanetta Addition and Champion Audio Reserve, within the H.T. & R.R. Company Survey, A-395. Parcel SY21-050


RECOMMENDATION: It is recommended City Council approve an ordinance authorizing the abandonment and sale of a 20 foot-wide prescriptive storm sewer easement in the location of Tasco Street west of the right-of-way line of Fondren Road, out of Lot 2 in Town of Jeanetta Addition and Champion Audio Reserve, within the H.T. & R.R. Company Survey, A-395, in exchange to the City for a consideration of $25,813.00. Parcel SY21-050

 

SPECIFIC EXPLANATION:
Richard Pena, of RSP Designs, LLC, on behalf of Fondren 5650, LLC, requested the abandonment and sale of a 20 foot-wide prescriptive storm sewer easement in the location of Tasco Street west of the right-of-way line of Fondren Road, out of Lot 2 in Town of Jeanetta Addition and Champion Audio Reserve, within the H.T. & R.R. Company Survey, A-395. The applicant intends to divide and replat the street between its abutting owners to provide additional land for future construction projects, and private drive access for each owner. The Joint Referral Committee reviewed and approved the request.

 

Fondren 5650, LLC, has completed the transaction requirements, accepted the City's offer, and has rendered payment. 

 

The City will abandon and sell to Fondren 5650, LLC:

 

Parcel SY21-050
1,000 square foot prescriptive storm sewer easement: $25,000.00
Valued at $25.00 per square foot x 100%

 

Depreciated value of improvements: $     813.00

TOTAL ABANDONMENT AND SALE: $25,813.00

 

It is recommended City Council approve an ordinance authorizing the abandonment and sale of a 20 foot-wide prescriptive storm sewer easement in the location of Tasco Street west of the right-of-way line of Fondren Road, out of Lot 2 in Town of Jeanetta and Champion Audio Reserve, out of the H.T. & R.R. Company Survey, A-395 in exchange to the City for a consideration of $25,813.00.

 

Fiscal Note: Revenue for this item is included in the FY2026 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
