Summary:

AMEND MOTION NO. 2023-0508, 8/2/2023, TO INCREASE spending authority in an amount not to exceed $1,000,000.00 for Emergency Bridge Repair Services for Houston Public Works, awarded to MC2 CIVIL LLC (Formerly NBG Constructors, Inc) - Special Revenue Fund

Background:

Emergency Purchase Order (P23-E32848.A1) - Amend Council Motion No. 2023-0508, passed on August 2, 2023, to increase the spending authority from $990,000.00 to $1,990,000.00 to MC2 Civil LLC (formerly NBG Constructors, Inc.) for emergency bridge repairs for Houston Public Works.

 

Specific Explanation:

The Chief Operating Officer of Houston Public Works (HPW) and the Chief Procurement Officer recommend that City Council Amend Council Motion No. 2023-0508 to increase the spending authority from $990,000.00 to $1,990,000.00 to MC2 Civil LLC (formerly NBG Constructors, Inc.) for additional repairs of the Tree Lane Bridge for HPW.  

 

The Chief Procurement Officer issued an emergency purchase order (EPO) to NBG Constructors, Inc. (now MC2 Civil LLC) on March 31, 2023.  This EPO was approved by City Council on August 2, 2023, by Council Motion No. 2023-0508.  On August 16, 2024, the Chief Procurement Officer amended the original EPO to increase the spending authority to $1,990,000.00.  The additional funds are required due to the expanded scope of work resulting from unforeseen conditions discovered after excavating under the Tree Lane Bridge.  Two (2) of the columns are not aligned sufficiently and are a structural concern.   The helical piles (that provide structural support) need to be replaced.  This may require additional grading to prevent erosion and outfall repairs.

This recommendation is made pursuant to Chapter 252, Section 252.022 (a) (2) of the Texas Local Government Code for exempted procurements, " which provides a procurement necessary to preserve or protect the public health or safety of the municipality's residents.”

 

MWBE Participation:

This procurement is exempt from the MWBE subcontracting participation goal because the department is utilizing an emergency purchase order for this purchase.

 

Hire Houston First:

This procurement is exempt from the City's Hire Houston First Ordinance.  Bids/proposals were not solicited because the department is utilizing an emergency purchase order for this purchase.

 

Fiscal Note:

Funding for this item is included in the FY25 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
