Approve an Ordinance amending Ordinance No. 2021-974, passed on November 10, 2021, as amended, to increase the maximum contract amount from $2,813,317.65 to $4,773,613.65 for the derivative agreement (4600016888) between the City of Houston and Wastech Corporation (previously, Rubicon Global, LLC) for the automated vehicle tracking, routing, and performance management system through the Houston-Galveston Area Council’s (H-GAC) Cooperative Purchasing Program, known as HGACBuy for Houston Information Technology Services (HITS) on behalf of Solid Waste Management Department.
Specific Explanation:
The Chief Information Officer (CIO) and the Chief Procurement Officer recommend that City Council approve an Ordinance amending to increase the maximum contract amount from $2,813,317.65 to $4,773,613.65 for the derivative agreement between the City of Houston and Wastech Corporation (previously, Rubicon Global, LLC) for the automated vehicle tracking, routing, and performance management system through the H-GAC’s Cooperative Purchasing Program, known as HGACBuy, for Solid Waste Management Department.
The original contract was approved on November 10, 2021, by Ordinance No. 2021-0974, for a three-year term with two (2) one-year renewal options, in the original amount of $993,328.05. An amending ordinance was approved on February 22, 2023, by Ordinance No. 2023-134 to increase the maximum contract amount from $993,328.05 to $1,953,320.85. A second amending ordinance was approved on March 6, 2024, by Ordinance No. 2024-129 to further increase the maximum contract from $1,953,320.85 to $2,813,317.65. The additional spending authority requested now will cover the costs for the fourth and fifth years of service and will increase the maximum contract amount from $2,813,317.65 to $4,773,613.65.
The RubiconSmartCity™ suite of products and services provided by the contractor include but are not limited to licensing, hosting, maintenance, and 24/7 tech support for automated tracking, routing, and performance management systems. The Geo Tab In-Cab Interface (ICI), Pod, and RUBICONVision portal products are cloud-based systems delivering real-time metrics including, but not limited, to garbage collections for solid waste and recycling vehicles. The system utilizes the City’s Geographic Information System (GIS) to create a foundation for all mapping activities associated with this system combined with wireless communications and software to deliver real-time computer maps and an externally mounted out-of-vehicle camera system.
This recommendation is made pursuant to subsection 271.102(c) of the Texas Local Government Code, which provides that "a local government that purchases goods or services from a cooperative purchasing program or organization satisfies any state law requiring the local government to seek competitive bids for the purchase of the goods or services.”
M/WBE Participation:
The awarded goal for this contract was 1.80% MWBE. Wastech Corporation (previously, Rubicon Global, LLC) is currently achieving 1.75%.
Fiscal Note:
Funding for this item is not included in the FY2025 Adopted Budget. Therefore, a Fiscal Note is required as stated in the Financial Policies.
