SUBJECT: Accept Work for Waterline Rehab and Replacement Project.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final contract amount of $2,760,991.57 or 19.97% under the original contract amount, accept the work, and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was required to provide for a work order based repair of water lines up to 24-inches in diameter in the distribution system on an emergency basis throughout the City.
DESCRIPTION/SCOPE: The project consisted of the repair, improvement and/or new installation of main water lines and service lines. The main lines range in diameter up to 24-inches and the water service lines range in size from ¾-inch to 2-inches in diameter. This was a work order-based contract with projects assigned on an as-needed basis. The project was awarded to D.L. Elliott Enterprises, Inc. with 730 calendar days allowed for construction and an original contract amount of $3,449,777.47.
LOCATION: The projects are located throughout the City of Houston.
CONTRACT COMPLETION AND COST: The contractor, D.L. Elliott Enterprises, Inc., last performed work under this contract in July 2023 within the original contract time. The contractor could not proceed with construction due to the death of the owner of D.L. Enterprises, Inc., Darryl L. Elliott. On August 10, 2023, legal counsel representing D.L. Elliott Enterprises Inc. notified the City of Houston of the death of the owner and requested the City of Houston release the company from the contract. The contract was suspended on October 19, 2023 in accordance with Document 00700-General Condition, Article 14. The City notified the contractor of the City’s intent to terminate the project for convenience by letter dated October 23, 2023. The final cost of the project, including overrun and underrun of estimated unit price quantities, is $2,760,991.57, a decrease of $688,785.90 or 19.97% under the original contract amount. Money remains encumbered under the contract. This recommended action will authorize Houston Public Works to administratively close this contract and to pay the remaining 1% retainage held by the City to the Contractor.
M/WSBE PARTICIPATION: The advertised M/WBE contract goals for this project were 12.00% MBE and 8.00% WBE. The M/WBE goals approved for this project were 12.00% MBE and 8.00% WBE. According to the Office of Business Opportunity, the actual participation achieved on this project was 20.93% MBE and 10.24% WBE. The M/WBE performance on this project was rated Outstanding for the following reasons: All goals were exceeded and goal credit subcontractors utilized. For the reasons listed, the MWSBE performance meets the requirements mandated by the City's MWSBE Program.
