SUBJECT: Contract Award for Sidewalk Program (Pkg. 4).
RECOMMENDATION: (SUMMARY) Reject low bid, return bid bonds, award Construction Contract for Sidewalk Program (Pkg. 4) to the second bidder, Tikon Group, Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the continuing effort by the City to construct request-based sidewalks throughout the City of Houston to meet the needs of its residents.
DESCRIPTION/SCOPE: The Citywide project provides for the construction of sidewalk improvements at various locations. This is a work order contract; projects will be assigned as they are designed in-house. The Contract duration for this project is 365 calendar days.
LOCATION: The projects are located throughout the City of Houston (City).
BIDS: The project was advertised for bidding on March 8, 2024, and March 15, 2024. Bids were received on March 28, 2024.The seven (7) bids are as follows:

AWARD: The apparent low bidder, Guthrie Contracting, withdrew their bid. Therefore, it is recommended that this Construction Contract be awarded to the second bidder, Tikon Group, Inc., with a bid amount of $2,438,811.00.

Testing Services will be provided by United Consulting Group, Ltd. (dba United Consulting), under a previously approved contract.
This project will use general funds that were allocated in the FY2024 budget for sidewalks.
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, Tikon Group, Inc. is a designated HHF company, but they were the successful awardee without application of the HHF preference.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor has elected to pay into the Contractor Responsibility Fund in compliance with City Policy.
M/WSBE PARTICIPATION: The contractor has submitted the following proposed program to satisfy the 13% MBE goal and 7% WBE goal for this project.
