SUBJECT: Request for a motion declining the acceptance of, rejecting, and refusing the dedication of a 25-foot-wide drainage easement, plat dedicated within Lots 24 and 25, Block 1 of the Memorial Thicket Section One Subdivision, out of the Harris County Map Records, Volume 224, Page 91. Parcel SY24-009
RECOMMENDATION: (Summary) It is recommended City Council approve a motion declining the acceptance of, rejecting, and refusing the dedication of a 25-foot-wide drainage easement, plat dedicated within Lots 24 and 25, Block 1 of the Memorial Thicket Section One Subdivision, out of the Harris County Map Records, Volume 224, Page 91. Parcel SY24-009
SPECIFIC EXPLANATION:
Simon L. Kanaan and Melinda Gronauer, underlying fee property owners of 702 Bow String Cove Houston, TX 77079 and 706 Bow String Cove Houston, TX 77079, requested the City to maintain a 25-foot-wide drainage easement, plat dedicated within Lots 24 and 25, Block 1 of the Memorial Thicket Section One Subdivision, out of the Harris County Map Records, Volume 224, Page 91. Real Estate Services and Transportation and Drainage Operations - Storm (TDO Storm) researched the City's ownership interest of the drainage easement and determined that the City does not have a property interest in the 25-foot-wide drainage easement. Since the drainage easement has never been used for drainage purposes and no future need for the drainage easement is foreseen, TDO-Storm determined the drainage easement could be processed as a non-acceptance and the underlying fee owners, will retain full ownership of the drainage easement.
It is recommended City Council approve a motion declining the acceptance of, rejecting, and refusing the dedication of a 25-foot-wide drainage easement, plat dedicated within Lots 24 and 25, Block 1 of the Memorial Thicket Section One Subdivision, out of the Harris County Map Records, Volume 224, Page 91.
Fiscal Note:
There is no impact to the fiscal budget or no additional spending authority. Therefore, no Fiscal Note is required as stated in the Financial Policies.
