Specific Explanation:
The Chief Operating Officer of Houston Public Works (HPW) and the Chief Procurement Officer recommend that City Council amend Council Motion No. 2024-0281 to increase the spending authority from $4,400,000.00 to $7,300,000.00 to PM Construction & Rehab, LLC for additional sanitary sewer line repairs for Houston Public Works.
The Chief Procurement Officer issued an emergency purchase order (EPO) to PM Construction & Rehab, LLC, on January 25, 2024. This EPO was approved by City Council on April 17, 2024, by Motion No. 2024-0281 in the amount not to exceed $4,400,000.00. On August 13, 2024, the Chief Procurement Officer amended the original EPO to increase the spending authority to $7,300,000.00. The additional funds are required due to the expanded scope of work resulting from unforeseen conditions that occurred during construction. The additional scope includes an altered downstream 54-inch monolithic reinforced concrete (MRC) sewer rehabilitation method due to poor structural conditions, bypass pumping operation extension, and extra traffic control.

This recommendation is made pursuant to Chapter 252, Section 252.022 (a) (2) of the Texas Local Government Code for exempted procurements, " which provides a procurement necessary to preserve or protect the public health or safety of the municipality's residents.”
MWBE Participation:
This procurement is exempt from the MWBE subcontracting participation goal because the department is utilizing an emergency purchase order for this purchase.
Hire Houston First:
This procurement is exempt from the City's Hire Houston First Ordinance. Bids/proposals were not solicited because the department is utilizing an emergency purchase order for this purchase.
Fiscal Note:
No significant Fiscal Operating impact is anticipated as a result of this project.
