Nature of Matter:

That Council adopt an ordinance approving and authorizing the execution of a Compromise, Settlement, Release and Indemnification Agreement between Porfirio Rodrigues and the City of Houston to settle Cause No. 2020-52826; Porfirio Rodrigues v. City of Houston; in the 334th Judicial District Court of Harris County, Texas

Brief Description:

On June 25, 2019, around 11:40 a.m. Plaintiff Porfirio Rodrigues (DOB: 9/15/1957; Hispanic male) was traveling in the right-hand lane near 4900 North McCarty Street approximately 200 feet from Old Spanish Trail. Porfirio Rodrigues was driving his 2017 Kia Rio at the time of the accident. Wilbert Earnest Gray, Jr. (African American male), a storm sewer equipment worker with the City of Houston Transportation & Drainage Operations, was driving a 2003 Sterling truck in the left-hand lane near 4900 North McCarty Street approximately 200 feet from Old Spanish Trail and was traveling to the dump.  Mr. Gray, Jr. claims he was attempting to change lanes to make a right-hand turn and did not see Mr. Rodrigues’ vehicle before colliding.  Mr. Gray, Jr.’s front right tire came into and remained in contact with the driver’s side of Mr. Rodrigues’ vehicle. HPD Vehicular Crimes Division scene investigator Officer E. Rubio found Mr. Gray, Jr. changed lanes when unsafe causing the accident. Mr. Gray, Jr. received a traffic citation for unsafe lane change as a result of this accident.

 

Fiscal Note:  Funding for this item is included in the FY2025 Adopted Budget.  Therefore, no fiscal note is required as stated in the Financial Policies.
