SUBJECT: Petition for the City’s consent to the addition of (6) tracts of land totaling 19.2632 acres to The Woodlands Road Utility District No. 1.
RECOMMENDATION: Petition for the City’s consent to the addition of (6) tracts of land totaling 19.2632 acres to The Woodlands Road Utility District No. 1 be approved.
SPECIFIC EXPLANATION: The Woodlands Road Utility District No. 1 (the “District”) was created through the Legislature in 1991, and currently consists of 2,563.3814 acres within Montgomery County and Harris County. The District is within the extraterritorial jurisdiction of the City of Houston (the “City”) and has petitioned the City for consent to add six (6) tracts of land totaling 19.2632 acres of developed land to the District. The proposed annexation tracts are in the vicinity of Woodlands Parkway, Huffsmith Road/ Rayford Road, Kuykendahl Road, and I-45. The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.
The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.
The District is a road utility district and the general nature of the work to be done in the area sought to be annexed to the District is the construction, acquisition, and improvement of macadamized, graveled or paved roads and turnpikes which serve or are intended to serve as arterial or main feeder roads, and any drainage works related to or in furtherance of the construction, acquisition or improvement of such roads.
The nearest drainage facility for The Woodlands Road Utility District No. 1 is Walnut Creek, within the Spring Creek watershed, which flows into the San Jacinto River, and finally into Lake Houston. The Woodlands has been developed in compliance with the Woodlands Master Drainage Report, including Supplement No. 1 and that plan incorporates the area being annexed. The proposed annexation tracts are not within the 100-year floodplain but are within the 500-year floodplain (2.16%).
By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City prior to their construction.
The Utility District Review Committee recommends that the subject petition be approved.
