Specific Explanation:
The Director of the Houston Health Department and the Chief Procurement Officer recommend that the City Council approve an ordinance authorizing a sole source agreement between the City of Houston and Aspyra, LLC in an amount not to exceed $504,468.52 for the purchase of hardware, software, equipment maintenance, and support services for the Houston Health Department's Cyberlab testing process system. The contract is for a one-year term with four one-year automatic renewals and is effective on the countersignature date.
The Cyberlab system is used to track HHD laboratory testing. According to this agreement, Aspyra will provide the following services: 1) enhance, adapt, modify, and maintain the software; 2) repair or replace specified parts; and 3) all repairs necessary to keep the equipment in good operating condition by the applicable functional specifications. The HHD laboratory performs approximately 185 different types of tests, which are utilized by clinics, hospitals, government agencies, and public health surveillance initiatives for the Houston Health Department.
This recommendation is made pursuant to subsection 252.022(a)(7) of the Texas Local Government Code, which provides that "a procurement of items that are available from only one source..." is exempt from the competitive requirements for purchases.
MWBE Participation:
The Sole Source agreement has a 0% M/WBE participation goal approved by the Office of Business Opportunity.
Pay or Play:
The proposed contracts requires compliance with the City’s Pay or Play ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides health benefits to eligible employees in compliance with City policy.
Hire Houston First:
This procurement requires compliance with the City’s “Hire Houston First” ordinance. Bids/proposals were not solicited because the department is utilizing a sole source vendor for this purchase.
Fiscal Note:
Funding for this item is included in the FY2025 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
