SUBJECT: Approve an Emergency Backup Supply Agreement between the City of Houston and Spanish Cove Public Utility District.
RECOMMENDATION: Approve an ordinance authorizing the Mayor to execute an Emergency Backup Supply Agreement between the City of Houston and Spanish Cove Public Utility District.
SPECIFIC EXPLANATION: The City of Houston (the “City”) desires to enter into an Emergency Backup Supply Agreement (the “Agreement”) with Spanish Cove Public Utility District (the “Spanish Cove PUD”) to obtain a supply of potable water for use during emergency situations.
The Agreement establishes the terms and conditions which govern the services provided. Each party desires to obtain a supply of potable water for use during emergency situations, billed at the City’s posted rate for Emergency Backup Supplies. The Existing Connection Location improvements will be funded, constructed, operated, and maintained by Spanish Cove PUD. These facilities will follow the City’s permitting requirements and be approved by the Texas Commission on Environmental Quality as defined in the agreement. The City will pay for the installation, maintenance, and repair costs associated with the second, Proposed Connection, as well as funding the upsize of the line along El Matador Drive. The City’s full share of the costs will be determined at the completion of the design phase and once completed and known, allocation will be requested from Council for the City’s share of the costs. The City and Spanish Cove PUD have determined that they are authorized to enter into this agreement under the Constitution and laws of the State of Texas, particularly Section 49.213, Texas Water Code, as amended.
