SUBJECT: Accept Work for FY 2022 Street & Drainage Rehabilitation Contract #3.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $4,056,333.74 or 1.41% over the original Contract Amount, accept the Work, and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the Transportation and Drainage Operations Program which provides work authorizations on a location-by-location as-needed basis, to preserve, repair, rehabilitate, and reconstruct the stormwater drainage asset including street rehabilitation to a condition that it may be effectively used for its designated functional purpose.
DESCRIPTION/SCOPE: This project consisted of the Citywide program that provided construction services to resolve localized stormwater drainage problems and rehabilitate the street to further improve drainage. The time allotted for this project was 730 calendar days. The project was awarded to J Rivas Construction, LLC with an original Contract Amount of $4,000,000.00.

CONTRACT COMPLETION AND COST: The Contractor, J Rivas Construction, LLC, has completed the work under the subject Contract. The project was completed within the original Contract time. The final cost of the project, including overrun and underrun of estimated unit price quantities is $4,056,333.74 an increase of $56,333.74 or 1.41% over the original Contract Amount. The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WBE contract goals for this project were 13.00% MBE and 7.00% WBE. The M/W/SBE goals approved for this project were 11.00% MBE, 7.00% WBE, and 2.00% SBE. According to the Office of Business Opportunity, the actual participation achieved on this project was 4.09% MBE, 1.56% WBE, and 0.16% SBE. The MWSBE performance on this project was rated Unsatisfactory due to the following reasons: Good Faith Efforts were not achieved in meeting the MBE and WBE goals nor in the utilization goal credit subcontractors to the extent possible. Good Faith Efforts documentation was not provided to OBO when requested and the deviation process was not leveraged resulting in a non-goal credit firm performing work slated to a goal credit subcontractor. For the reasons listed, the MWSBE performance does not meet the good faith efforts requirements mandated by the City's MWSBE Program.
