RECOMMENDATION: (SUMMARY) Adopt an Ordinance approving an Additional Appropriation of $304,678.57 for Groundwater Facility/Re-Pump Station/HVAC & Ventilations System Improvements at Various Locations - Package 1.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City’s groundwater facility/re-pump station rehabilitation and replacement program and is required to meet the area’s water demand and also ensures compliance with the Texas Commission on Environmental Quality regulations program.
DESCRIPTION/SCOPE: The project consists of improvements to various ground water facilities/re-pump stations. Improvements include renovations, pump installation/rehabilitation, replacement of electrical switchgear, generators, valves, meters, motors, and HVAC & ventilation system. The Project was awarded to LEM Construction Company, Inc. with an original Contract Amount of $11,920,200.00.

ADDITIONAL APPROPRIATION: An approval is requested for an additional appropriation of $304,678.57 in excess of the original contract value for additional work described in Change Order No. 11, relocate step-down transformer at Jersey Village, contractor extended field presence due to transformer delays and procure spare parts for all project locations, District 184 bus duct upgrades, and Forest Cove 3 well pump breaker upgrade. This scope of work is necessary to complete the execution of this project due to the inspection results.
The total requested appropriation is $326,833.93 to be appropriated as follows:
• Contract Services $304,678.57
• Testing Services $ 6,921.43
• CIP Cost Recovery $ 15,233.93
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) ordinance that promotes economic opportunity for Houston business and supports job creation. In this case LEM Construction Company, Inc., is a designated HHF company, but they were the successful awardee without application of the HHF preference.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 13.00% MBE goal and 7.00% WBE goal. The original Contract amount totals $11,920,200.00. The Contractor has been paid $11,554,873.00 (96.94%) to date. Of this amount, $4,596.522.20 (39.78%) has been paid to M/WBE sub-contractors to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $12,224,878.57. The MWBE goal has been met.
FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
