RECOMMENDATION: Adopt an ordinance approving and authorizing a Additional Appropriation to an Advance Funding Agreement between the City and TxDOT for the 2020 Highway Safety Improvement Program (HSIP).
PROJECT NOTICE/JUSTIFICATION: Texas Transportation Commission Minute Order Number 116073 authorizing the State to undertake and complete highway improvements for the 2020 HSIP.

PREVIOUS HISTORY AND SCOPE: On October 21, 2020, under Ordinance No. 2020-0916, City Council approved the submission of five Grant Applications to the Texas Department of Transportation Highway Safety Improvement Program (HSIP). HSIP is a federally mandated program managed by TxDOT that works to achieve the reduction of traffic fatalities and serious injuries on all public roads. Funds in the amount of $84,095.00 were appropriated for the local match to the grant.
On April 5, 2023, City Council adopted Ordinance No. 2023-0231 approving an Advance Funding Agreement for the installation of traffic signals and traffic signal improvements. Under the Agreement, the City was responsible for the design of the improvements and contributing funds for 100% of TxDOT’s Direct Costs and a 10% local cost share toward construction of two project locations. HPW had requested Council appropriate $280,231.00 for TxDOT Direct Costs and the estimated 10% local cost shared under the preceding agenda item. The City allocated funds in the amount of $308,254.10 under Ordinance No. 2023-230 on April 5, 2023.
SCOPE OF THE AGREEMENT AND FEE: This additional appropriation request is due to an overrun, based on the original estimated cost and the actual bid price for each project. This resulted in an increase from $308,254.10 to $956,044.51, a difference of $647,790.41. The projects were funded with Federal funds participating in a fixed amount for each project. The City is responsible for all costs in excess of the Federal share. The additional funds in the amount of $647,790.41 will be utilized for payment to TxDOT to cover the overrun cost invoiced by TxDOT.
The total requested amount of $712,569.45 is to be appropriated as follows: $647,790.41 for the overrun cost, and $64,779.04 for CIP Cost Recovery.
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
