Pass a motion to approve the final contract amount of $1,609,053.66, or 2.46% over the original contract amount of $1,570,493.00 and under the 10% contingency amount, to accept the work, and to authorize the final payment.
The contractor, Axiom Construction Company, LLC, has completed all the work required under the contract in the amount of $1,609,053.66 for the Terminal A Restroom Renovation Project at George Bush Intercontinental Airport/Houston (IAH) (Project No. 637). The final contract amount of $1,609,053.66 includes four change orders with a net value of $38,560.66.
During construction, the project was managed and inspected by Houston Airport System (HAS) personnel.
It is now requested that Council pass a motion to approve the final contract amount of $1,649,180.66, or 2.46% over the original Contract Amount and under the 10% contingency amount, accept the work, and authorize the final payment.
The advertised and approved MWSBE contract goals for this project were 20% MBE and 28% SBE (48% total). According to the HAS Office of Business Opportunity, the actual participation achieved on this project was 15.79% MBE and 22.95% SBE (38.74% total.) The standard for meeting MWSBE participation goals is the demonstration of Good Faith Efforts. The Contractor’s MWSBE performance on this project was rated Satisfactory due to Good Faith Efforts for the following reasons: (1) The firm made good faith efforts to achieve the MWSBE goals of this contract while utilizing all goal credit subcontractors to the extent possible. (2) Due to the age of the file and the turnover of HAS OBO personnel, it is unfair to penalize the prime for something that has not been filed properly. For the reasons listed, the Contractor’s performance meets the intent and spirit of the City’s MWSBE program.
