Emergency Purchase Order (P23-E33100) – Approve spending authority to Boyer, Inc. in an amount not to exceed $4,100,000.00 for emergency repairs to sanitary sewer lines for Houston Public Works.
Specific Explanation:
The Chief Procurement Officer and the Director of Houston Public Works recommend that City Council approve spending authority in an amount not to exceed $4,100,000.00 for emergency repairs to sanitary sewer lines and that authorization be given to issue a purchase order to Boyer, Inc.
The Chief Procurement Officer issued two (2) emergency purchase orders (EPO) to Boyer, Inc. The first EPO was issued on September 25, 2023, for emergency repairs to a damaged 42” Sanitary Sewer line along Aldine Bender. This line was installed as part of the agreement with the City’s Wastewater Consent Decree. The newly installed line had not yet been put in service when HPW discovered that a third-party, non-City contractor working on a nearby construction project impacted the City’s newly constructed sewer line. This caused an approximately 19”x19” hole through the new trunk line at the intersection of Aldine Bender and Surles. The third-party contractor has not taken responsibility for the damage, leaving the City to repair the damage and eventually litigate to recoup costs.
The second EPO was issued on October 6, 2023, for emergency repairs to an existing 42” and 18” concrete reinforced sanitary sewer lines located at the WCID 111 wastewater treatment plant. The 42” influent gravity sewer line unexpectedly failed creating a +30 ft. diameter sink hole and a subsequent sanitary sewer overflow that resulted in a regulatory violation. It has also compromised the 8” sludge force main that runs parallel to the sewer line used to waste. The damaged line is approximately 630’ LF at 30’ depth.
Storms have led to the formation of another sink hole at the 18” line that is currently being used for bypass. This sinkhole resulted in a road closure and has restricted operational access to the plant. This affects HPWs’ ability to wet haul the needed waste sludge from the process.
Boyer, Inc. will provide all supervision, labor, material and equipment to excavate, identify, and repair all damages in a timely manner to prevent sanitary sewer overflows and maintain our compliance with TCEQ. The emergency purchase order was issued to Boyer, Inc. because they are familiar with the work requirements and were able to provide repair crews with short notice. All work is expected to be completed in April 2024.
This recommendation is made pursuant to Chapter 252, Section 252.022 (a) (2) of the Texas Local Government Code for exempted procurements, " which provides a procurement necessary to preserve or protect the public health or safety of the municipality's residents.”
MWBE Participation:
This procurement is exempt from the MWBE subcontracting participation goal because the department is utilizing an emergency purchase order for this purchase.
Hire Houston First:
This procurement is exempt from the City's Hire Houston First Ordinance. Bids/proposals were not solicited because the department is utilizing an emergency purchase order for this purchase.
Fiscal Note:
Funding for this item is included in the FY24 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
