Summary:

ORDINANCE finding and determining that public convenience and necessity no longer require the continued us of a 12-foot-wide alley, between Mount Vernon Avenue and Yoakum Boulevard, Block 49, amending  map of Montrose Addition, Obediance Smith Survey, Abstract 696, Houston, Harris County, Texas; abandoning said alley to the abutting property owner, Covenant House Texas, in exchange for cash installments over the next five years, services, and other good and valuable consideration - DISTRICT C - KAMIN

Background:
  • SUBJECT: Ordinance authorizing the abandonment and sale of a 12-foot-wide alley, from Mount Vernon Avenue east to Yoakum Boulevard, located out of Block 49 of the Amending Map of Montrose Addition, out of the Obediance Smith Survey, Abstract 696. Parcel SY21-064

 

RECOMMENDATION: (Summary) It is recommended City Council approve an ordinance authorizing the abandonment and sale of a 12-foot-wide alley, from Mount Vernon Avenue east to Yoakum Boulevard, located out of Block 49 of the Amending Map of Montrose Addition, out of the Obediance Smith Survey, Abstract 696. Parcel SY21-064

 

 SPECIFIC EXPLANATION: 

Chuck Davis of C.L. Davis and Company, on behalf of Covenant House, requested the abandonment and sale of a 12-foot-wide alley, from Mount Vernon Avenue east to Yoakum Boulevard, located out of Block 49 of the Amending Map of Montrose Addition, out of the Obediance Smith Survey, Abstract 696. The applicant plans to construct a four-story, 104,000 square foot building that will help youth transition into adulthood. The Joint Referral Committee reviewed and approved the request. 

 

Covenant House has complied with the transaction requirements, has accepted the City's offer, has submitted a deposit, and will enter into a Restrictions and Development Agreement with the City, and will render the first installment of a five installment payment plan. The City recognizes that Covenant House's proposed development on the property will result in a large increase in capacity for the housing of homeless youth and related services, and, as such, the City estimates a significant cost avoidance over the next 20 years. 

 

The City will abandon and sell to Covenant House:

3,599 square feet alley easement:    $587,897.00 (R) 
Valued at $165.00 per square foot x 99%               
       
Depreciated value of improvements (asphalt)   $2,175.00  

 

TOTAL ABANDONMENT AND SALE:                      $590,072.00  
       

Therefore, it is recommended City Council approve an ordinance authorizing the abandonment and sale of a 12-foot-wide alley, from Mount Vernon Avenue east to Yoakum Boulevard, located out of Block 49 of the Amending Map of Montrose Addition, out of the Obediance Smith Survey, Abstract 696.

 

Fiscal Note:

"Revenue for this item is included in the FY2024 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies."
