SUBJECT: First Amendment to the Construction Contract between the City of Houston (City) and Main Lane Industries, Ltd. for the Bikeway Development and Improvements Project.
RECOMMENDATION: (SUMMARY) Approve the First Amendment to the Construction Contract with Main Laine Industries, Ltd., and appropriate additional funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Street and Traffic Capital Improvement Project and is required to meet City of Houston standards as well as to improve bikeways, mobility, and safety at intersections.
DESCRIPTION/SCOPE: This construction project consists of the installation of new bikeway lanes. The work includes striping bike lanes, pavement markings, traffic signal modification, sidewalks, driveways, utility adjustments, curbs and medians, wheelchair ramps, and other work as assigned.
LOCATION: The project is located throughout the City of Houston.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on August 25, 2021, under Ordinance No. 2021-0734. The scope of services under the Original Contract consisted of citywide pavement markings and the installation of new bikeway lanes.
SCOPE OF THIS AMENDMENT AND FEE: The additional appropriation is necessary to ensure proper funding is available for the final stages of signage and striping needed for safety regulation within bikeway lanes and intersections. The amendment is required due to Article 3.1 of the contract that states that the sum of Contract Prices of all Work Orders issued, shall not exceed the original awarded contract amount of $1,378,500.00. An approval is requested for an additional appropriation of $303,270.00.

HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) ordinance that promotes economic opportunity for Houston business and supports job creation. In this case Main Lane Industries, Ltd. is a designated HHF company, but they were the successful awardee without application of the HHF preference.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ Ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 12.94% MBE goal and 8.72% WBE goal. The original Contract amount and subsequent additional appropriation totals $1,378,500.00. The Contractor has been paid $1,297,250.36 (94.11%) to date. Of this amount, $538,850.64 (41.54%) has been paid to M/WBE sub-contractors to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $1,654,200.00. According to the Office of Business Opportunity, the Contractor’s M/WBE participation is currently at 41.54%.
FISCAL NOTE: No significant fiscal operating Impact is anticipated as a result of this project.
