Summary:

ORDINANCE appropriating $3,032,033.00 out of Dedicated Drainage and Street Renewal Capital Fund - Drainage Charge; approving and authorizing Professional Real Estate Services Contract between City of Houston and COBB, FENDLEY & ASSOCIATES, INC for North Canal High Flow Diversion Channel; providing funding for CIP Cost Recovery relating to construction of facilities financed by the Dedicated Drainage and Street Renewal Capital Fund - Drainage Charge - DISTRICTS C - KAMIN and H - CISNEROS

Background:

SUBJECT: Professional Real Estate Services Contract between the City and Cobb, Fendley & Associates, Inc. for North Canal High Flow Diversion Channel.

 

RECOMMENDATION:  An ordinance approving a Professional Real Estate Services Contract with Cobb, Fendley & Associates, Inc. for North Canal High Flow Diversion Channel, and appropriate funds.

 

PROJECT NOTICE/JUSTIFICATION: This project is part of the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) to provide professional engineering services for real estate acquisitions support services. 

 

 DESCRIPTION/SCOPE:  This project consists of three (3) primary components that would be constructed to reduce flooding adjacent to nearby locations, as well as upstream. These components include the North Canal Channel Diversion, South Canal Channel diversion and Detention, street bridge improvements, and associated channel improvements at Yale Street and Heights Blvd. Construction of the diversion channels requires property acquisition and a railroad relocation, along with the diversion channels, downstream easements are required to ensure the integrity and functionality of both the North and South Canal Channels.


The City is a sub-recipient of a HMGP grant award for the project, as authorized by City Council under Ordinance 2019-1027, however the current grant award budget is insufficient to fund the proposed contract activities. The City will seek reimbursement of eligible contract expenses through the HMGP grant should additional grant funds be made available.

 

LOCATION: The project area is generally bound by Wood Street on the north, Allen Street on the south, McKee on the east and Main Street on the west. 

 

SCOPE OF CONTRACT AND FEE: Under the scope of the Contract, the Consultant will perform Real Estate Services. Compensation is based on cost of time and materials with not-to-exceed agreed upon amount.

 

The total cost of this project is $3,032,033.00 to be appropriated as follows: $2,887,650.00 for Contract services and $144,383.00 for CIP Cost Recovery.

 

 PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Consultant provides health benefits to eligible employees in compliance with City policy.

 

M/WBE PARTICIPATION:  The standard M/WBE goal set for the project is 24.00%. The Consultant has proposed a 26.18% MWBE plan to meet the goal.
