SUBJECT: Accept Work for FY2017 Local Drainage Project Construction Work Orders #1.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $4,067,438.23 or 1.69% over the revised Contract Amount, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the Capital Improvement Plan (CIP) and is required to preserve, repair, rehabilitate or reconstruct the stormwater drainage asset to such a condition that it may be effectively used for its designated functional purpose.
DESCRIPTION/SCOPE: This project consisted of construction services to resolve localized stormwater drainage problems that have been nominated by the Street and Drainage Division. The project scope was established by each work order. The work orders were prioritized based on a range of factors from public safety to level-of-service. The project duration for this project was 730 calendar days. The project was awarded to T Construction L.L.C. with an original Contract Amount of $2,000,000.00 and an additional appropriation of $2,000,000.00 for a revised total contract amount of $4,000,000.00.
LOCATION: The projects are located throughout the City.
CONTRACT COMPLETION AND COST: The Contractor, T Construction L.L.C., has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 1095 days approved by Change Order Nos. 8 and 9. The final cost of the project, including overrun and underrun of estimated unit price quantities is $4,067,438.23, an increase of $67,438.23 or 1.69% over the revised Contract Amount. The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/W/SBE contract goals for this project were 11.00% MBE and 7.00% WBE (18.00% total). The approved goals for this project were 16.00% MBE, 7.00% WBE (23.00% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 11.09% MBE and 9.14% (20.23% total). The standard for meeting M/W/SBE participation goals is the demonstration of Good Faith Efforts. The Contractor's M/W/SBE performance on this project was rated Satisfactory for the following reasons: The Prime exceeded the advertised goals of this contract and made good faith efforts to utilize all goal credit subcontractors to their full capacity. For the reasons listed, T Construction LLC's performance met our expectation and the intent and the spirit of the City's MWSBE program.
