ORDINANCE appropriating $59,206.60 out of Water & Sewer System Consolidated Construction Fund; authorizing the transfer of $394,621.20 from Water & Sewer System Consolidated Construction Fund into the HPW-SETL Construction Fund and appropriating of $3,266,072.20 out of Water Authorities Capital Contribution Fund - SETL; authorizing the transfer of $1,063.627.64 from Water Authorities Capital Contribution Fund - SETL into the Water & Sewer System Consolidated Construction Fund for Cost Recovery; approving and authorizing fifth amendment to Professional Engineering Services Contract between City of Houston and LOCKWOOD, ANDREWS & NEWNAM, INC for Southeast Transmission Water Line (Approved by Ordinance No. 2015-0623, as amended); providing funding for CIP Cost Recovery relating to construction of facilities financed by Water & Sewer System Consolidated Construction Fund - DISTRICT E - MARTIN

Background:

SUBJECT: Fifth Amendment to the Professional Engineering Services Contract between the City of Houston and Lockwood, Andrews & Newnam, Inc. for the Southeast Transmission Water Line.

 

RECOMMENDATION: Approve the Fifth Amendment to the Professional Engineering Services Contract with Lockwood, Andrews & Newnam, Inc. and appropriate funds.

 

PROJECT NOTICE/JUSTIFICATION: This project will provide the basis for design of needed improvements in the City's Southeast Water System. The improvements are focused on replacing and upsizing the existing 42-inch water transmission line along Old Galveston Road (SH 3) from Fuqua to Clear Creek. The 42-inch water line needs to be replaced due to repeated failures that have reduced the reliability of the line. The project will increase flow capacity to the City and the City's Co-Participant customers served by the Southeast Water Purification Plant System (Southeast Water System).

 

DESCRIPTION/SCOPE: This appropriation will fund various professional engineering services and additional services in support of a feasibility study for replacing the existing 42-inch water line along Old Galveston Road. The study will provide a basis for preparing final design documents for the recommended improvements. The services include routing analyses, hydraulic modeling, easement investigations, and preparing specific recommendations for improvements associated with water service to the City's Southeast Water System.

PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on June 24, 2015 under Ordinance No. 2015-0623. The scope of services under the original contract consisted of funding various professional engineering services and additional services in support of a feasibility study for replacing the existing 42-inch water line along Old Galveston Road. The study provided a basis for preparing final design documents for the recommended improvements. The services included routing analyses, hydraulic modeling, easement investigations, and preparing specific recommendations for improvements associated with water service to the City's Southeast Water System. Under this contract, the Consultant has accomplished completion of the Southeast Transmission Line Feasibility Study Report, SH 3 Distribution Water Line Preliminary Engineering Report, real estate support, contract management services, cathodic protection, Supervisory Control and Data Acquisition, transient analysis, cost sharing support for Co-participants, financial models, and projection. SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the Fifth Amendment, the Consultant will accomplish the following: Design and Real Estate Acquisition for the 54-inch transmission main (Southeast Transmission Water Line Extension). Additional Services include survey, geotechnical investigation, environmental assessment, stormwater pollution prevention plan, tree protection plan, independent quantity review, cathodic protection, hydraulic modeling, shut down planning, transient analysis, cost sharing support for Co-participants, public information assistance, field coordination support, appraisal services, negotiations, title examination services, relocation, preliminary condemnation services and disposal of improvements associated with acquiring easements. A fee of $1,320,000.00 is budgeted for Basic Services and $1,914,600.00 for Additional Services.


The total requested appropriation is $3,719,900.00 to be appropriated as follows: $3,234,600.00 for contract services and $485,300.00 for CIP Cost Recovery.

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City Contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.

 

M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.63%. The original contract amount and subsequent appropriations total $21,929,800.00. The Consultant has been paid $7,583,967.00 (34.58%). Of this amount, $2,159,512.00 (28.47%) has been paid to M/WBE sub-contractors to date. Assuming approval of the requested amendment, the contract amount will increase to $25,164,400.00. The Consultant proposes the following plan to meet the M/WBE goal.
