SUBJECT: Agreement to Contribute Right-of-Way Funds (Fixed Agreement) between the City of Houston (City) and Texas Department of Transportation (TxDOT) for improvements to FM 526 from Nola Court to IH 10.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Agreement to Contribute Right-of-Way Funds (Fixed Agreement) between the City of Houston and Texas Department of Transportation (TxDOT) for FM 526 improvements and allocate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the improvements to be made by TxDOT on Highway No. FM 526, which necessitates the acquisition of certain right-of-way. Texas Transportation Codes established that TxDOT shall design, construct, and operate a system of highways in cooperation with local governments. Texas Transportation Code also authorizes TxDOT and a Local Government to enter into agreements in accordance with Texas Government Code Chapter 791.
The City desires to enter into a fixed price joint participation agreement to contribute to TxDOT funding participation, for the cost of acquiring the right-of-way for the improvement to FM 526.
LOCATION: The project area is generally bound by Wallisville Road on the north, and Interstate Highway 10 on the south, Oates Road/Mercury Drive on the west, and Normandy Street on the east.
SCOPE OF THE AGREEMENT AND FEE: This agreement between the City and TxDOT entails the acquisition of certain right-of-way for improvements to FM 526, from Nola Court to Interstate Highway 10.
The total estimated cost of this right-of-way acquisition is $1,000.00. The City’s participation and contribution of the cost will be in the amount of $100.00.
The total requested amount to be allocated for the cost of the right of way acquisition is $100.00.
FISCAL NOTE: Funding for this item is included in the FY2024 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
