Summary:

ORDINANCE appropriating $5,509,984.29 out of Dedicated Drainage and Street Renewal Capital Fund – Ad Valorem Tax as an additional appropriation; approving and authorizing first amendment to a Professional Engineering Services Contract between City of Houston and GAUGE ENGINEERING, LLC for Antoine Paving and Drainage from West Mount Houston to US290 (Approved by Ordinance No. 2021-0556); providing funding for CIP Cost Recovery relating to construction of facilities financed by the Dedicated Drainage and Street Renewal Capital Fund – Ad Valorem Tax - DISTRICTS A - PECK and C - KAMIN

Background:

SUBJECT: First Amendment to the Professional Engineering Services Contract between the City and Gauge Engineering, LLC for Antoine Paving and Drainage from West Mount Houston to US 290.

 

RECOMMENDATION: Approve the First Amendment to the Professional Engineering Services Contract with Gauge Engineering, LLC and appropriate funds.

 

PROJECT NOTICE/JUSTIFICATION: This project is part of the Capital Improvement Plan (CIP) and is a federally funded construction project. The project will include the plans, specifications and estimate package as per Texas Department of Transportation (TxDOT) requirements and general engineering consultant oversight.

 

DESCRIPTION/SCOPE: This project consists of various professional engineering services and additional services in support of paving and drainage for Antoine Drive from West Mount Houston to US 290. The work will include the development of a project scope through the preparation of the Design Concept Report (DCR) for the limits between Victory Drive and US 290. The report will include traffic analysis results and hydraulic modeling simulations/analyses. The project will also provide environmental assessments as per TxDOT's requirements. The project provides overall technical oversight and General Engineering Consultant Services of various design packages as well as preparation of documents as necessary for the implementation of the project, including plans, specifications, and estimates. Improvements include full roadway, drainage, traffic, utilities reconstruction, removal, and replacement of three bridges, and the construction of a new bridge over the existing Burlington Northern and Santa Fe Railway.

 

LOCATION: The project area is generally bound by SH-249 (Tomball Parkway) on the north, IH-10 (Katy Freeway) on the south, IH-45 Freeway on the east, and West Sam Houston Parkway on the west.  

 

PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on June 23, 2021 under Ordinance No. 2021-0556. The scope of services under the original contract consisted of Basic and Additional Services, as applicable, for Phase I - Design Concept Report (DCR).  Phase I - DCR Basic and Additional Services, which also included the review and oversight of the current Final Design of West Mount Houston to Victory Drive).  Under this contract, the Consultant has accomplished a 50% completion of Phase I Basic and Additional Services. The below subsequent Council Action associated with this contract include:

SCOPE OF THIS AMENDMENT AND FEE: Under the scope of this Amendment, the Consultant will accomplish the following: General Engineering Consultant Services from US 290 to West Mount Houston and Phase II and III Design from Cole Creek to Victory. A fee of $2,453,760.00 is budgeted for Basic Services and $2,793,844.09 for Additional Services.

 

The total requested appropriation is $5,509,984.29 to be appropriated as follows: $5,247,604.09 for contract services and $262,380.20 for CIP Cost Recovery.

 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City Contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.

 

M/WBE PARTICIPATION: The M/WBE standard goal for this project is 33.10%. The original contract amount and subsequent appropriation totals $3,185,818.04. The Consultant has been paid $2,611,063.00 (81.96%). Of this amount, $780,437.00 (29,89%) has been paid to M/WBE sub-contractors to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $8,433,422.13. The Office of Business Opportunity will continue to assess the Contractor's Good Faith Efforts and monitor the Contract for MWBSE Compliance.
