The automobile collision giving rise to this lawsuit occurred at 3:55 p.m. on July 7, 2015, in the intersection of the 4100 block of Greenbriar Dr. and US Highway 59. Shaunteka St. Julian, driving the City’s rear-loading Freightliner Garbage truck, was traveling southbound on Greenbriar, and collided with Plaintiff in the intersection of the 21000 block of the feeder road to US Highway 59 and Greenbriar Dr. A review of the video from the cab of the City vehicle showed Ms. St. Julian ran the red light immediately before entering the intersection. Plaintiff sustained bodily injuries as a result of the collision and received medical treatment. Plaintiff filed this tort case on June 12, 2017, seeking damages of up to $250,000.00 under the Texas Tort Claims Act for bodily injury, past and future physical impairment, and medical expenses. The parties mediated this case and have agreed to resolve the litigation.
The Legal Department recommends that Council adopt an Ordinance authorizing and approving the Settlement, Release and Indemnity Agreement and the payment of $135,000.00 out of the Property and Casualty Fund (1004) in settlement of Plaintiff’s claims.
Fiscal Note: Funding for this item is included in the FY2023 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
