Enact an ordinance amending Ordinance 2021-2 to increase the total maximum contract amount to $43,000,000.00 for Professional Materials Engineering and Testing Services Agreements with 1) Terracon Consultants, Inc.; 2) Aviles Engineering Corporation; 3) Professional Service Industries, Inc.; 4) Geotest Engineering, Inc.; 5) Raba Kistner, Inc. 6) Ninyo & Moore Geotechnical and Environmental Sciences Consultants; 7) Kenall, Inc. dba Ratnala & Bahl; 8) Associated Testing Laboratories, Inc.; 9) All-Terra Engineering, Inc.; 10) Gorrondona Engineering Services, Inc.; 11) DAE & Associates, Ltd. dba Geotech Engineering and Testing; and 12) QC Laboratories, Inc.
SPECIFIC EXPLANATION:
On January 6, 2021, City Council approved Ordinance 2021-2 approving and authorizing Professional Materials Engineering and Testing Services Agreements, and setting a total maximum contract amount of $13,000,000.00, with the following companies:

5. Fugro USA Land, Inc.

|
6. Raba Kistner, Inc.

7. Ninyo & Moore Geotechnical and Environmental Sciences Consultants

8. Kenall, Inc. dba Ratnala & Bahl
|
|
9. Associated Testing Laboratories, Inc.
|
|
10. All-Terra Engineering, Inc.
|
|
11. Gorrondona Engineering Services, Inc.
|

12. DAE & Associates, Ltd. dba Geotech Engineering and Testing

13. QC Laboratories, Inc.

The contract with Fugro USA Land, Inc. is being terminated for convenience as the firm no longer performs work in Houston.
The term of the agreements is five years with two one-year options.
Work is assigned to contractors on an as-needed basis to various construction contracts to assure the quality of the construction materials and compliance with each project’s specifications. Funds are appropriated for these testing services contracts under the same ordinances appropriating funds for associated construction contracts. Services include the following:
- Geotechnical investigations;
- Construction materials testing and inspection;
- Mix designs verification;
- Non-destructive concrete examination; and
- Assist HAS engineers in forensic studies, structural steel surveys, and electrical testing.
Total appropriations for testing services are approaching the current $13,000,000.00 maximum contract amount, necessitating the action now requested of City Council. Increasing the total maximum contract amount by $30M to the new amount of $43,000,000.00 will provide enough capacity for anticipated construction work to FY2025.
Fiscal Note:
There is no impact to the fiscal budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
