RECOMMENDATION: Approve an Ordinance (i) de-appropriating the sum of $14,096.00 out of the Construction Manager at Risk (CMAR) contract with SpawGlass Construction Corporation (previously appropriated by Ordinance No. 2022-0078); and (ii) appropriating an equivalent amount to the professional architectural services contract with Brave / Architecture, Inc. for the project.
SPECIFIC EXPLANATION: On February 2, 2022, by Ordinance No. 2022-0078, City Council appropriated funds to the Construction Manager at Risk Contract with SpawGlass Construction Corp. for the new Westbury Neighborhood Library, including a 5% construction contingency of $52,457.50. Due to the bordering neighborhood’s request to change the library’s address from 5505 Belrose Drive to an address on Chimney Rock Road, additional architectural services are required. Additional architectural services are also required to meet recently revised Houston Fire Department site requirements.
Therefore, the General Services Department recommends that City Council de-appropriate $14,096.00 out of the Construction Manager at Risk (CMAR) contract with SpawGlass Construction Corporation and appropriate an equivalent amount to the professional architectural services contract with Brave / Architecture, Inc. for additional services.

PREVIOUS HISTORY AND PROJECT SCOPE: On November 20, 2019, by Ordinance No. 2019-911, City Council approved a professional architectural services contract with Brave / Architecture, Inc. to perform design and construction phase services for a new Westbury Neighborhood Library for the Houston Public Library (HPL).
On August 25, 2021, by Ordinance No. 2021-749, City Council approved an additional appropriation of funds to the professional architectural services contract with Brave / Architecture, Inc. to perform revised flood control design and construction phase services for a new Westbury Neighborhood Library for the HPL.
M/WBE INFORMATION: The contract was awarded with a 26.67% M/WBE goal. To date, Brave / Architecture, Inc. has achieved 18.4% participation. It is anticipated that Brave / Architecture, Inc. will achieve the goal by the completion of the contract.
FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
